Spell Smash — Terms of Use (End User License Agreement)

These Terms of Use ("Terms") are an agreement between you and Pudra Yayıncılık ("we", "us", "our"), publisher of the mobile game Spell Smash ("the App") under the Neo Games label. By downloading, installing or playing the App you accept these Terms. If you do not agree, do not use the App.

1. Who can play

You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under 18, a parent or guardian must agree to these Terms on your behalf and is responsible for your use, including any purchases.

2. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the App on Apple devices that you own or control, for your own entertainment, as permitted by the App Store terms. All rights not expressly granted remain ours.

You may not:

• copy, modify, translate, reverse-engineer, decompile or create derivative works of the App, except where the law allows it;
• sell, rent, lend, sublicense or otherwise distribute the App or any part of it;
• use cheats, bots, exploits, modified clients or automation, or interfere with the App's operation;
• remove or alter any copyright or trademark notice.

3. Virtual items and in-app purchases

The App contains virtual items such as gold, moves, hints, jokers, lives, the Word Vault and item packs ("Virtual Items"). Some are earned by playing; some can be bought with real money through Apple's in-app purchase system.

• Virtual Items are a limited licence to use features of the App. They have no money value, cannot be exchanged for cash, cannot be transferred to another person or account, and may be changed or withdrawn if the App changes.
• Prices are shown in the App before you buy and are charged to your Apple ID. Apple's terms apply to the payment.
• Consumable items (gold, power-ups, lives, opening the Word Vault) are used up in play and are not restored on a new device. Non-consumable items (for example Remove Ads) can be restored with the "Restore Purchases" button in the Shop.
• Because Virtual Items are delivered immediately, purchases are final and non-refundable except where the law or Apple's refund policy says otherwise. Refund requests are handled by Apple at https://reportaproblem.apple.com.
• The one-time Starter Sack offer is shown once per installation and cannot be reclaimed later.

4. Subscriptions

The App offers an auto-renewable subscription, "Infinite Lives Monthly", which gives unlimited hearts while it is active.

• The subscription lasts one month and renews automatically for the same period at the price shown in the App, unless you cancel at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID at confirmation of purchase and at each renewal.
• You can manage or cancel the subscription at any time in your device Settings › Apple ID › Subscriptions. Deleting the App does not cancel the subscription.
• If the renewal payment fails, Apple may keep the subscription active for a short grace period while it retries; after that the benefit stops until payment succeeds.
• No refund is given for the unused part of a period, except where required by law.
• Price changes are announced in advance through Apple; continued use after a change means you accept the new price, subject to Apple's consent rules.

The time-limited Infinite Lives passes (24 hours, 7 days) are consumable purchases, not subscriptions, and expire on their own.

5. Advertising

The App may show advertisements, including optional rewarded ads that give an in-game benefit for watching. Ads are provided by third-party networks and we are not responsible for their content or for the products they advertise. The "Remove Ads" purchase removes interstitial ads; optional rewarded ads remain available by your choice.

6. Progress and data

Your progress is stored on your device. It is not tied to an account and we cannot recover it if the App is deleted or the device is lost. Our Privacy Policy explains what information the App collects and how it is used; it forms part of these Terms.

7. Changes and availability

We may update, change or discontinue the App or any feature, level, item or price at any time, including for balance reasons. We try to keep the App available but do not guarantee it will always work without interruption or error. We may suspend your access if you break these Terms.

8. Intellectual property

The App, including its code, artwork, characters (including Ms. Spelly), names, logos, music and level designs, is owned by us or our licensors and protected by copyright and trademark law. "Spell Smash" and "Neo Games" are our marks. Third-party trademarks appearing in level names (for example car makes or landmarks) belong to their owners and are used descriptively only.

9. Disclaimer of warranties

The App is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer that cannot be excluded by law.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or Virtual Items. Our total liability for any claim relating to the App is limited to the amount you paid us through the App in the twelve months before the claim, or 50 US dollars if you paid nothing.

11. Termination

You may stop using the App at any time by deleting it. We may end your licence if you break these Terms. On termination your licence to the App and to Virtual Items ends; sections 8 to 13 survive.

12. Apple-specific terms

The App is distributed through Apple's App Store, and the following applies in addition:

• These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim relating to the App, including product-liability claims, legal or regulatory claims, or consumer-protection claims.
• If a third party claims the App infringes its intellectual-property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of the claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Apple's Licensed Application End User License Agreement applies to the extent these Terms do not cover a matter.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the courts of Istanbul, without prejudice to mandatory consumer-protection rules that give you the right to bring a claim where you live. If any part of these Terms is found unenforceable, the rest remains in force.

14. Changes to these Terms

We may change these Terms. The effective date above shows the latest version. Material changes will be announced in the App or on the App Store page; continuing to use the App after a change means you accept it.
